Please read these Terms of Service carefully before engaging COFE Engineering Solutions. These terms establish the basis for our professional relationship and outline the rights and obligations of both parties.

1. Acceptance of Terms

1.1

By contacting COFE Engineering Solutions, requesting a quotation, or entering into a services agreement with us, you confirm that you have read, understood, and agree to be bound by these Terms of Service.

1.2

These terms apply to all clients, visitors to our website, and any party that engages our professional construction and finishing services in Kenya.

1.3

We reserve the right to update these terms at any time. Continued use of our services after changes are published constitutes acceptance of the revised terms.

2. Services

2.1

COFE Engineering Solutions provides specialised construction finishing and protective services including epoxy flooring, waterproofing, tiling, and painting across Kenya.

2.2

All services are subject to a site assessment and written quotation. Work commences only upon client approval of the quotation and agreement on the scope of works.

2.3

We reserve the right to decline any project that we determine to be outside our scope of expertise, unsafe, or contrary to applicable laws and regulations.

2.4

Timelines provided are estimates and may be affected by site conditions, material availability, or other factors beyond our reasonable control. We will communicate any delays promptly.

3. Payment Terms

3.1

Payment terms are outlined in the project quotation or service agreement. A deposit may be required before commencement of works.

3.2

Final payment is due upon completion of works and client sign-off, unless otherwise agreed in writing. Overdue payments may attract interest at a rate permissible under Kenyan law.

3.3

All prices are quoted in Kenyan Shillings (KES) and are exclusive of VAT unless otherwise stated. Any applicable taxes will be itemised separately.

3.4

We accept payment via M-Pesa, bank transfer, or other methods agreed in writing. Cash payments exceeding statutory limits may not be accepted.

4. Client Obligations

4.1

The client is responsible for ensuring safe and timely access to the project site during agreed working hours, including provision of utilities (water and electricity) required for the works.

4.2

The client must ensure that the site is prepared as instructed prior to commencement, including removal of furniture, fittings, or obstructions unless otherwise agreed.

4.3

The client must designate a responsible contact person for site communications and decisions throughout the project duration.

4.4

Modifications to the agreed scope of works requested after commencement will be treated as variations and may result in additional costs and timeline adjustments.

5. Warranties & Liability

5.1

We warrant that our works will be free from major defects arising from poor workmanship for a period specified in the project agreement, typically ranging from 12 to 24 months depending on the service type.

5.2

Warranties are void if the installed systems are subjected to abuse, improper maintenance, unauthorised modifications, or conditions outside their specified performance parameters.

5.3

Our liability for any claim arising from service delivery shall not exceed the total value of the contract under which the claim arises.

5.4

We are not liable for indirect, consequential, or incidental damages including loss of use, loss of revenue, or loss of business opportunity arising from delays or service defects.

6. Governing Law & Disputes

6.1

These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.

6.2

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation within 30 days of written notice of the dispute.

6.3

If negotiation fails, disputes may be referred to mediation or arbitration as agreed in writing, before resorting to litigation.
